1. About these terms

These terms apply to your use of this website, operated by ByteX, an independent technology consultancy based in Tasmania, Australia. By using the website you accept these terms. If you do not accept them, please do not use the site.

2. Website content is general information only

The content on this website, including service descriptions and use cases, is general information about the kind of work ByteX does. It is not technical, legal, financial or professional advice, and it is not a proposal or a quotation.

Use cases describe representative situations and approaches. They are illustrative. They do not describe specific past client projects and they are not a guarantee that the same approach will suit or succeed in your business.

3. No guaranteed outcomes

Outcomes described on this site are expressed as operational improvements that a project may deliver. ByteX does not guarantee any particular revenue, cost saving, time saving, search ranking or business result. Actual outcomes depend on your systems, data quality, processes and how the solution is adopted by your staff.

4. Third-party products and integrations

This website refers to third-party products and platforms. Those references describe work performed with each product's publicly documented capabilities. They do not imply endorsement, certification, accreditation, reseller status or an official partnership unless expressly stated in writing.

All third-party names and trade marks remain the property of their respective owners.

Whether any particular integration is achievable depends on the third party's available APIs, your subscription tier, granted permissions and that vendor's terms of service. These can change, or be withdrawn, at any time and without notice. Nothing on this website is a commitment that a specific integration will be possible for your account.

5. Indicative pricing

Any prices shown on this website are indicative starting points published to help you gauge the likely level of investment. They are not an offer, a quotation, or a fixed price, and no contract is formed by them.

Indicative prices exclude applicable third-party subscriptions, licences and transaction charges. What a piece of work actually costs depends on the systems involved, the access and permissions available, the state of the existing data and the agreed scope. A written scope and quotation are provided before work begins, and that quotation prevails over anything published here.

Prices shown are in Australian dollars. ByteX may change published pricing at any time; a change does not affect a quotation already accepted in writing.

6. Services are provided under a separate agreement

Consulting and development work is provided under a separate written scope or agreement between ByteX and the client. These website terms do not create a contract for services, and do not vary any agreement that is in place.

ByteX provides scheduled, project-based and appointment-based services. It does not provide emergency support, guaranteed response times or 24/7 availability, except where expressly agreed in a written maintenance arrangement.

7. Enquiries

Submitting an enquiry does not create a contract, a commitment by ByteX to take on the work, or a service relationship. ByteX may decline any enquiry. Please do not send confidential information, credentials or sensitive personal information through the enquiry form.

Information you submit is handled as described in the Privacy Policy.

8. Acceptable use

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorised access to the website or its underlying infrastructure
  • Submit false, misleading, abusive or automated enquiries
  • Interfere with the availability of the website, including through automated request volume
  • Scrape or reproduce the site's content for commercial purposes without permission

Rate limiting and spam protection are applied to the enquiry form. Access may be restricted where use is inconsistent with these terms.

9. Intellectual property

The content, design, code and structure of this website are owned by ByteX unless otherwise indicated. You may view and print pages for your own business purposes. You may not republish, sell or substantially reproduce the content without written permission.

10. External links

Where this website links to external sites, those sites are not under the control of ByteX. ByteX is not responsible for their content, availability or privacy practices, and a link is not an endorsement.

11. Availability

ByteX aims to keep this website available but does not guarantee uninterrupted access. The site may be unavailable for maintenance, or because of factors outside its control.

12. Limitation of liability

To the maximum extent permitted by law, ByteX is not liable for any loss or damage arising from your use of, or reliance on, this website or its content.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where liability can be limited rather than excluded, it is limited to resupplying the relevant service or paying the cost of having it resupplied.

13. Changes to these terms

These terms may be updated from time to time. The version published on this page applies to your use of the website.

14. Governing law

These terms are governed by the laws of Tasmania, Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
